Terms of Service

The rules for using Hoopstack: who may hold an account, what you are responsible for, what we do with what you put in, and how an account ends.

Who these terms are with

Hoopstack is operated by Hoopstack LLC. These terms are an agreement between you and Hoopstack LLC.
Questions about these terms, and notices under them, go to privacy@hoopstack.ai. Notice sent to that address is effective notice to us.
You accept these terms by creating an account or by using Hoopstack.

Hoopstack accounts are for coaches, organization owners, parents and players.
You must be 13 or older to create your own Hoopstack account.
A player under 13 may be recorded in Hoopstack as a profile created by their coach or club, with the consent of a parent or guardian, and must not create an account themselves.
This is enforced: creating your own account requires a date of birth and refuses anyone under 13, with no exception for consent. Attaching a login to a profile a coach created earlier is refused too, unless a parent or guardian's consent for that player is already on record.

Coaches, organization owners, players and parents are responsible for keeping their account access secure.
Team staff should only invite people who are authorized to access a player, team or organization workspace.
You are responsible for what you upload, including whether you had the right to record information about another person.

Parent or guardian consent may be required before a parent is given access to a child's information.
Consent records, withdrawal, and the version of the text consented to are product records and may be audited.
Clubs are responsible for having the right to record information about the young people on their rosters.

Development plans are produced by an artificial intelligence system from the evaluations entered about a player.
They are a coaching aid. They are not medical, psychological, safeguarding or legal advice.
A coach is responsible for reviewing a generated plan before using it with an athlete, which is why a plan must be approved before the player and parent can see it.

Do not use Hoopstack to harass anyone, to record information about a young person without the right to do so, or to attempt to reach information about players you are not assigned to.
Do not attempt to circumvent the access rules that separate organizations, teams and families.

You can delete your own account from inside the mobile app at any time. What that destroys and what it leaves behind is described in our Privacy Policy.
We may suspend or close an account that breaks these terms, in particular the acceptable-use rules above. A suspended account cannot sign in.
Where we can tell you first, we will. Where the conduct puts a young person or another user at risk, we may suspend first and explain afterwards.
If your account is suspended you can write to privacy@hoopstack.ai to ask why and to ask us to reconsider, and a person will answer you.
A suspended account keeps its data. If we decide to close it rather than restore it, what is destroyed and what stays with the organization is exactly what our Privacy Policy describes for a deleted account.

What you put into Hoopstack stays yours. Documents, evaluations, notes and messages belong to you or to the organization you put them in on behalf of, not to us.
You give us permission to store, copy and display that content for one purpose: running Hoopstack for you and for the people you have given access to. That permission is what lets us hold a document, show an evaluation to an assigned coach, and generate a development plan from it.
Evaluation answers are also sent to OpenAI to produce a development plan. Our Privacy Policy says exactly which fields leave our systems and which never do.
We do not sell your content, we do not license it to anyone else, and we do not use it to train models of our own.
This permission lasts as long as the content is in Hoopstack. When content is deleted it ends, subject to the one honest exception our Privacy Policy describes: a copy already inside a backup is not reached by that deletion.
Content recorded on behalf of a club stays with the club when you leave. Deleting your own account does not remove the team's records, and our Privacy Policy sets out that boundary in detail.

We do not promise that Hoopstack will be available without interruption. We deploy changes, we take the service down for maintenance, and things break.
Hoopstack is a coaching tool. Do not rely on it as the only record of something that matters — a medical note, a safeguarding record, or a document you cannot obtain again.
We may change or withdraw features. Where a change removes something you depend on, we will say so on this page and, where we can reach you, by e-mail.

Hoopstack is provided as it is. We do not warrant that it will be error-free, that a generated development plan will be correct or suitable, or that it will meet a particular need.
A generated plan is a coaching aid and nothing more. The section above on generated development plans is the operative one, and a coach's review is what stands between a plan and an athlete.
Nothing here limits a liability that cannot be limited by law, and nothing here affects rights a consumer has that cannot be waived.

If we change these terms we will update the date at the top of this page.
If a change materially affects your rights or what you owe us, we will notify account holders by e-mail before it takes effect, rather than relying on the date alone.
If you do not accept a change, you can delete your account, which is described above and in our Privacy Policy.
